Reform UK has come under fire for its \u201cridiculous\u201d plan to launch Royal Navy ships to stop small boat arrivals from France.<\/p>\n
Dubbed Operation Fortress by Nigel Farage, his party has pledged to launch \u201cthe largest military operation in the English Channel since World War Two\u201d to intercept migrant boats and return them to France or Belgium.<\/p>\n
But the plan has sparked criticism from both political opposition, former navy officers and legal and migration experts, who claimed the plan \u201clacks quite a lot of substance\u201d and would be unworkable under maritime law. <\/p>\n
The party has proposed setting up a joint military command with units from the Royal Navy, Royal Marines, RAF and British Army as well as a surveillance command to track incoming boats.<\/p>\n
The armed forces would intercept any unauthorised boats and detain their occupants, giving them water and food and a medical assessment before returning them to France or Belgium under escort on UK vessels.<\/p>\n
James M Turner KC, barrister in maritime law at Quadrant Chambers, said you would need agreement from France in order to use British vessels to return migrants to French shores. He told The Independent: “The long and short of it is this \u2013 you can\u2019t as a state go and do stuff in another state\u2019s territory without its permission. It would create a huge diplomatic stink. So even if you could sweep up everyone on a rubber boat, you can’t just drop them in another state.\u201d<\/p>\n
Libby Kane, spokesperson at migrants\u2019 rights charity JCWI, said Reform\u2019s proposals were a “dangerous and militarised response” which will make violence and death at the border and in the Channel worse.<\/p>\n
Reform UK leader Nigel Farage during a press conference on Monday (PA)And retired Royal Naval commander Tom Sharpe said the navy does not have ships to spare to carry out the operation, and questioned the \u201csubstance\u201d of the policy.<\/p>\n
\u201cA billion-pound warship that\u2019s configured for anti-air warfare or anti-submarine warfare, which are both threats to the UK, is not best used ferrying people around. You\u2019re better off using an actual ferry,\u201d he told BBC Radio 4\u2019s Today programme.<\/p>\n
Downing Street also pointed out that when the Royal Navy had primacy for small boat crossings in 2022 there was no reduction during that period.<\/p>\n
No 10 said border patrol officers were the \u201cbest suited candidate\u201d to deal with such operations, and the prime minister\u2019s spokesman added: \u201cThe Royal Navy is already tackling many threats, including monitoring any Russian warships operating near our shores, protecting our waters and our critical national infrastructure.\u201d<\/p>\n

Labour criticised the \u201creheated\u201d announcement and said \u201canger and easy answers won\u2019t bring crossings down\u201d.<\/p>\n
\u201cReform have reheated an old announcement in their latest desperate bid to distract from their growing sleaze scandals,\u201d a party spokesperson said.<\/p>\n

Shadow home secretary Chris Philp dismissed the plan as a \u201cgimmick\u201d that Reform have \u201cno detailed plan nor funding\u201d to back up.<\/p>\n

Meanwhile, former British Army officer and Conservative MP Ben Obese-Jecty MP said: \u201cReform have announced this ridiculous idea before, except now it\u2019s party policy.\u201d<\/p>\n
The party says the plan is in line with international law and that it will both halt small boat arrivals and act as a humanitarian response, but has faced questions over its legality.<\/p>\n
In a press conference on Monday, Mr Farage insisted it would comply with international law and said: \u201cIt will save lives, it will help the French in fulfilling their job of stopping the boats and it will save a huge amount of money.<\/p>\n
\u201cWe are very confident that our policy of securely picking people up and safely taking them back to France \u2013 we are entirely confident that that falls within other conventions of international law.\u201d<\/p>\n
Nigel Farage said Reform\u2019s proposals would save lives (PA)However, James M Turner KC told The Independent that while UK vessels entering French waters have a right of innocent passage, taking migrants trying to cross the Channel and returning them back to France would not be in accordance with that right. <\/p>\n
He explained: “Unloading any person in contravention of the receiving state\u2019s immigration laws would disqualify the passage from being innocent, under Article 19.2(g) of UNCLOS. If it is against the wishes of that country, it would also offend its territorial integrity and sovereignty.”<\/p>\n
While Border Force vessels are able to collect small boat migrants from dinghies in British waters, this will be much harder in French waters as migrants are less likely to want to board the boats if they know they will be returned to France.<\/p>\n
Mr Turner explained: \u201cThe reason asylum seekers will climb onto Border Force vessels is because they know they will come to the UK. If instead they know they will be returned to France, they will resist getting onto the vessels, and you will create a situation of real danger. It is extremely dangerous.\u201d<\/p>\n
Under Boris Johnson\u2019s government, home secretary Priti Patel wanted to use Border Force vessels to push back small boats into French waters. However, the policy was never implemented, probably for safety reasons. It was withdrawn after it faced significant legal challenge and was never backed by the Royal Navy.<\/p>\n
Mr Turner added: \u201cIt is practically impossible to push someone back over a line in a safe manner without endangering them.\u201d<\/p>\n
While Nigel Farage has said Reform will not perform pushbacks in the Channel, trying to \u201crescue\u201d migrants from dinghies who do not want to be \u201crescued\u201d by UK vessels may encounter similar problems.<\/p>\n
Jon Featonby, chief policy analyst at Refugee Council, said: \u201cThe last thing anyone should be proposing is anything that would risk more loss of life, as this plan inevitably would. It\u2019s also not clear that this plan is even deliverable, as there\u2019s no guarantee France or Belgium would take people back.\u201d<\/p>\n
The Reform party said the navy\u2019s River-class offshore patrol vessels would be used for interception.<\/p>\n
The ships\u2019 current responsibilities include monitoring Russian naval activity around British waters.<\/p>\n
